摘　　要：大数据时代电信诈骗事件成为重大社会问题,数起大学生遭遇电信诈骗事件引发广泛关注,如何打击地下非法的个人数据售卖活动成为一个亟待解决的问题。如何避免数据非法外泄或滥用的悲剧发生,数据流通交易存在有哪些法律问题,如何从制度上防范和规避数据交易中的法律风险是本文所关注的。文章从数据交易的业务模式,数据交易的核心法律问题进行了分析,提出了相关的完善建议。Telecom fraud often occurs, and several accidents that the university student S suffered from telecom fraud have recently attracted much attention from people. And how to fight the covert illegal personal-data selling behaviors becomes a problem needing prompt solution. This paper focuses on how to avoid the tragedy occurrence of illegal data disclosure or abuse, what kind of law problems exist in data circulation and transaction, and how to institutionally prevent and evade the legal risks in data transactions. Finally the key legal problems in data transaction, including data transaction mode, are analyzed, and the related suggestion for perfection also proposed.
