在宪法框架内设定住宅用地使用权续期方案

摘　　要：住宅用地使用权免费续期方案有违宪嫌疑,其与宪法上的国家土地所有权条款相悖,违反宪法对合法私有财产的平等保护原则,未能区分宪法上的所有权和使用权。续期原则上应当交费,但是从公民生存权优先于国家财产权的角度看,不交费不会影响其居住权,但会限制其转让权。考虑到国有土地"全民所有"的属性以及"基本经济制度以及财政制度"的法律保留规定,续期方案应当由全国人大及其常委会的立法或解释规定。从宪法和立法上看,国家垄断城市土地所有权和竞价模式结合导致土地使用权流转成本比较高;所以在续期时,不能采取高持有成本模式。合理的续期方案应是改批租制为年租制,年租费率应由全国人大及其常委会确定,其中住宅用地的续期费率应考虑民生需要,区别于工商业用地。对用于获取出租收入的住宅用地,可以收取区别性续期费率。少数使用权即将到期的地方,全国人大及其常委会可以授权地方人大先行先试。The renewal plan for the right of using residential land without any charge bears heavy suspicion of unconstitutionality. Upon expiration of the term of assignment of the use of land, the land user should pay the renewal fee if he contin- ues to use it. But because the civil rights to subsistence takes precedence over national property rights, if the home owner can not pay the renewal fee, it will not affect his right of habitation, but limit his right to transfer. The renewal scheme should be made by the National People＇s Congress. It cannot take the high holding cost model in dealing with the renewal problem. It is reasonable that we should change the land leasehold system to land annual rent system up for renewal. The annual rent rate should be determined by the NPC and its standing committee.
