摘  要:食品安全领域运用"黑名单"的手段越来越多,适用情况也很复杂。根据各地规定、做法的不同,"黑名单"的性质也有所不同。对于其性质认定,学界目前并没有达成一致,主要是传统行政法视角下的行政处罚说、行政强制说、信息公开说、行政指导说、行政事实行为说。面对这种新型的政府规制手段,不妨跳出传统行政法的束缚,转而通过行政过程论的分析方法,在政府规制理论视角下对其进行重新的认知与定性。理想的认知模式是:企业存在特定的不良记录-纳入"黑名单"-公布-禁止,是整个信息规制链的概括。The "blacklist" in food security can be used in more situations, and the situations can be more complicated. According to the different provisions and the different approaches, the nature of the "blacklist "is also different. For its nature we find there is no academic consensus, mainly including the administrative penalty, administrative enforcement, information disclosure, administrative guidance, administrative factual behavior under the traditional administrative law. Faced with this new means of government regulation, we might as well jump out of the shackles of traditional administrative law ,turn to the analysis of the administrative process theory ,and conclude the new understanding under the government regulation perspective. The legal cognitive model is : companies a specific bad record - included into the "black list" - released - debarment, which can be the summary of the whole information regulation chain.
