涉外医疗机构外文书写医疗文书依法监管问题探讨

摘　　要：2015年6月,国务院办公厅印发了《关于促进社会办医加快发展若干政策措施》,进一步促进形成多元办医格局。目前,随着国际交流合作日益频繁,涉外医疗机构成为了社会多元办医中的一个重要组成部分。然而,在对涉外医疗机构的监管过程中发现,由于机构管理者和外国医师对我国医疗卫生法律法规和规范的知晓程度不足,造成涉外医疗机构中医疗文书使用外文书写的现象较为普遍。本文针对外文书写医疗文书如何依法监管,及其翻译文本的法律效力如何界定等一系列问题进行分析探讨,并提出对策建议,为涉外医疗机构的医疗卫生执法监督提供思路和借鉴。In June 2015, the general office of the State Council issued a number of policies and measures to speed up the development of private ＇medical institutes to further promote the formation of diversified medical pattern in China. At present, with frequent international exchanges and cooperation, foreign-related medical institutions have become a signifi- cant part of medical resources. However, most foreign-related medical institutes＇ managers and foreign doctors have little knowledge about China＇s health laws and regulations, resulting in medical documents written in a foreign language were common in these institutes. This article analyzes and discusses the administration practice of medical documents writing in foreign languages and the legal validity of translation text of medical documents, also provides thought and reference for the supervision of foreign related medical institutions.
