摘 要:基于对宅基地价值与功能的不同预期,普通农村的农民"违建"具有不同于征拆区农村的发生逻辑。当前宅基地管理政策聚焦于征拆区农村的"违建"治理,并体现为强化行政管理权和弱化集体所有权的管理思路,忽视和压制了普通农村大多数农民正当的宅基地使用权要求,宅基地管理逐渐脱嵌于村庄社会。管理错位和服务缺位造成对农民建房法律空间与物理空间的双重挤压,这是农民"违建"持续发生的制度根源。加强基层组织建设,积极回应和引导农民的宅基地使用权需求,以服务再造管理,是破解基层土地管理困境的根本之道。Based on different expectations to the value and function of homestead,the logic of farmers' illegal construction in ordinary rural areas is different from that in the requisition and removal areas.The current policy of homestead management focuses on the illegal construction in the requisition and removal area,which has reflected the management ideas of strengthening the executive power and weakening collective land ownership,and has also ignored and suppressed the proper demand of homestead of the majority in ordinary rural areas,thus making the homestead management gradually dis-embed off the village society.The management dislocation and the absence of service have caused double squeeze to the legal space and physical space of peasant house-building,which is the systematic origin of illegal construction.Strengthening the construction of grassroots organizations and actively responding and guiding the farmer's demand of homestead,which mean management reconstruction with service,are the fundamental ways to break the dilemma of basic land management.
