摘　　要：信息公开和数据开放是当前政府信息资源管理中的两大政策体系。通过对现有文献和英美两国政策的总结与反思,本文尝试重构政府数据开放与信息公开的关系。基于对信息和数据本质的再认识,在不否认理论渊源上信息公开强调知情权,数据开放侧重资源利用的前提下,本文认为数据开放无论从概念、法律、价值和管理上都是信息公开的一部分。实际的政策制定可以在保证政策逻辑基本自洽的前提下放松本文的概念约束,在技术层面对信息和数据做出合理划分,但是制度上应致力构建统一的政府数据资源管理体系。Information freedom and open data are both important policies of government information resources management now. Based on the existing literatures and policies of UK and USA, this article attempts to reconstruct the relationship between government data open and information freedom. Based on the recognition of the nature of information and data, without theoretically denying information freedom laying more emphasis on the right to information and open data being more focused on the reuse of resources, we clarified that in terms of concepts, laws, values ？？ and management, open data should be the part of the information freedom. The actual policy - making can make a reasonable division of information and data at the technical level by relaxing the definition herein, but should aim to build a more unified and stronger co - ordination policy system of government data resource management at the institution level.
