摘　　要：大学纠纷解决机制是大学自主权的重要组成部分,也是大学自治的重要保障,应当从大学自治的视角来构建大学纠纷解决机制。大学首先应当在作为"大学自治宪法"的大学章程中对大学内部纠纷解决机制作出整体构架,并通过制定具体的大学规章制度予以落实。教育行政部门则应通过制定部门规章的方式,落实申诉等大学纠纷解决机制,由此倒逼国家从顶层设计的角度完善大学纠纷解决机制。University dispute settlement mechanism is not only an important part of self-determination right of university, but also an important guarantee of university governance, we should establish university dispute settlement mechanism from the perspective of university autonomy. We should make the overall architecture of university internal dispute settlement mechanism in Statutes of the university as university constitution of autonomy, and implement it by making concrete university rules and regulations. Education administrative department should formulate administrative rules to carry out the university of dispute resolution mechanisms such as complaints. The legislature will perfect university dispute resolution mechanism from the Angle of the top-level design.
