美国核出口管制政策的法律维度——以美国对法国核政策为视角

摘　　要：二战后美国为达成对核产品及其技术的出口管制,先后出台了一系列相关政策及法律。这些政策及法律对国际社会防止核扩散问题提供了可资借鉴的标准,具有深远影响。聚焦特定双边关系下的美国对法国的核出口管制政策并加以历史解读,有助于深入理解美国核出口管制政策及法律背后的利益考量。美国核出口管制呈现出以下特点:核出口管制的实施程序和控制机制存在着多元化的法律规则体系;核出口管制的目标呈多层次化,但易陷入评估困境;核出口管制政策的管理模式,实质上是运用法律进行治理的模式。After the World War II, a serial of acts and policies have been adopted by federal government and congress in order to implement nuclear export control, which have provided the international community with some kind of standard on nuclear export control and influenced nuclear non - proliferation system. It would be helpful for us to understand the nuclear export control policy and the interest consideration behind the law to focus on America＇s policy towards French in the regulation of nuclear export historically. In fact, American nuclear export control system has some characteristics as follows： firstly, nuclear export control procedure and mechanism have different multiple regulation systems; secondly, American management of nuclear export control is under the rule of law; thirdly, there are multiple objectives in nuclear export control, but it＇s hard to assess the effect.
