摘　　要：传统上劳动法主要是一个国内性质的法律部门,劳动法背后隐含的运行架构是主权国家。全球化条件下,传统劳动法制度不敷所用,越来越多的劳工保护问题发生在传统劳动法法域之外,或者发生在主权国家管辖外的机构和场所。在此背景下,本文强调应当加强跨国劳动法的研究,以一种积极的姿态回应全球化条件下的劳工保护和社会正义问题。跨国劳动法的生成和滋长,恰恰是在主权国家管辖之外,或在传统的劳动法领域之外,亦或在传统的劳工保护机构和体制之外。跨国劳动法并非是简单地将国内劳动法或者国际劳动法的适用范围扩展到跨国空间,而是在跨国领域之中建立自成一体的劳工保护实体规则、程序规则和机构制度。跨国劳动法的研究,一方面拓展了劳动法学科的研究领域、强化了话语权,另外一方面也要求加强劳动法学科的国际面向,加强劳动法与国际公法、国际组织法、国际经济法、对外关系法、国际关系等学科的交叉合作与研究。Traditionally speaking, labour law is profoundly a domestic discipline and the operation of labour law is normally confined within the realm of a sovereign. However, it has been observed that, in the context of globalization, traditional labour law appears impotent in providing sufficient protection for workers. More and more, the issue of labour protection is dealt with either outside the traditional realm of labour law, or beyond the sovereign domain. Against this background, the article advocates the study of transnational labour law with a proactive attitude towards labour protection and social justice in the- globalization process. Transnational labour law grows and develops outside of the sovereign jurisdictions or traditional labour law discipline. Transnational labour law is not simply to extend the application of na- tional or international labour law into transnational domain. Instead, it is a construction of a political and juridical space of its own, in which the substantive labour norms, procedures and institutions are deeply intertwined with and mutually reinforceeach other. The development of transnational labour lawwill ex- pand the scope of labour law research and add international flavor to the discipline.Meanwhile, it also car- ries with it the challenge to labour law scholars of how to develop inter--disciplinary research through working closely with scholars of international law, international organizations and international relations.
