摘 要:主流法学关于民族村寨文化保护与传承的研究一开始便被附着了规范法学的尾赘,整体融合式的建构主义进路是民族村寨文化保护与传承法人类学的进路,这一结论包含研究视域整体主义的重新定向、研究方法论的根本转换及规范体系的重新建构。沿此进路,对村寨文化遗产现行法核心范畴即权利和权力现象进行法人类学细化分析,得出民族村寨文化保护与传承法人类学的一般规则,即法律信仰的在地性规则、文化主体规则、村寨原生文化存续与可延展规则。In the main stream of jurisprudence, the study on the protection and inheritance of ethnic village cultures has initially been determined with a complement of normative jurisprudence, and, the approach of integrated constructivism is actually the approach of legal anthropology in the protection and inheritance of ethnic village cultures. This conclusion consists of three components, namely, holistie reorientation of research perspective, basic transition on research methodology and reconstruction of normative system. Through this approach a detailed scenic analysis on legal anthropology can be made about the phenomenon in the core range, such as the right and the authority, caused by current laws in village cultural heritage, from which the regulations in four categories can be achieved in ethnic village cultural protection and inheritance. They are general legal anthropologic regtdation, the regional regulation for law abidance, the regulation for cultural subject and the regulation for the sustained original eco-cultural development in ethnic villages.
