摘　　要：刑法和刑事政策的关系问题已逐步成为我国刑法学界关注的热点问题,但对这一问题的研究最终还是要通过对具体犯罪的实证加以检验。在以具体个罪为视角的微观切入中,赌博犯罪不失为较好的考察平台。就刑法的刑事政策化而言,鉴于赌博犯罪治理之当下困境,应该承认赌性的客观存在,提供合适的疏导路径,疏堵结合将体现未来赌博犯罪治理在理论上的突破。就刑事政策的刑法化而言,需要适时调整诸多刑事政策思潮对赌博犯罪刑事立法产生的影响,通过以法定犯赌博罪代替自然犯赌博罪来应对和解决治理困境。The relationship between criminal law and criminal policy has gradually become a hot issue among scholars of criminal law in China. But research on this issue eventually needs to be inspected by specific crimes. In the micro perspective of a specific crime, gambling crimes can be a good platform for investigation. In terms of the criminal policy of criminal law and in view of the current predicament in the governance of gambling crimes, we should recognize the objective existence of gambling, provide appropriate counseling path, and combine guidance with prohibition, which will reflect a theoretical breakthrough in the future governance of gambling crimes. As far as criminal policy of criminal law is concerned, proper adjustment should be made in criminal policies and thoughts which will exert impact on the occurrence of criminal legislation of gambling so as to cope with and solve the governance predicament through statutory crime of gambling instead of natural crime of gambling.
