摘　　要：借鉴国外陪审制度经验基础上建立的中国特色人民陪审员制度,长期陷入"陪而不审"之尴尬局面。人民陪审员制度改革迫在眉睫。在此背景下,不少地方法院改革试点大陪审制合议庭制度。虽然取得一定成效,然而多数改革存在陪审员定位偏差,履职积极性不高,责任机制缺失,与现行合议制相冲突的问题。解决这种困境的关键在于做出相应的程序设计,具体包括:陪审员的选任机制的完善、保障陪审员充分履职,构建合议庭责任机制以及改进合议庭细则,以实现人民陪审员制度的真正价值,推进我国合议庭制度改革,以期推动司法体制改革良性发展。By learning the experience of the Jury system , China has developed the People Jury System as the current jury system , which now is in an embarrassing situation , and it is urgent to reform the system .But in the trial , there still are many problems .In order to realize the true value of jury system and promote the smooth progress of the reform , we should pay more attention to perfect trial basis approaches and the courts .Certain steps should be taken , such as the improvement of the Juror＇s selectin, ensuring the Juror conscien-tious, the collegial panel accountability mechanisms , and the improvement of the collegial panel regulations , etc.
