摘　　要：藏区"赔命价"习惯法在当代的实践中,已不同于古代的实体规则,而是一种与刑事和解相类似的调解方式。"赔命价"习惯法有其积极的作用,它在形式、价值上都与我国的刑事和解制度具有契合之处,应以刑事和解为蓝本,对"赔命价"进行合法化改造,从程序、内容、效力上予以规范,以实现"赔命价"的现代转型。In contemporary practice,Tibetan Customary Law of ＂Compensation for Life＂has been different from the ancient rules,while it is similar to the criminal reconciliation. ＂Compensation for life＂ customary law has its positive role.It has the conjunction with criminal reconciliation system in the form and value,so it should transformed legally based on criminal reconciliation in the procedures, content and validity, to realize the modern transformation of the compensation price.
