论我国学校教育中儿童参与权的法律保障

摘　　要：学校教育中的儿童参与权是儿童参与学校管理及教育教学活动的权利。我国学校教育中的儿童参与权实现有限,亟需法律保障。我国现行相关法律法规存在诸多不足:一些规定过于概括、儿童有效参与教学管理和教学活动的规则缺乏、权利行使和救济机制不完善,难以有效保障学校教育中的儿童参与权。为此,应切实履行《儿童权利公约》规定的义务,将儿童参与原则规定为儿童权利保护的基本原则,增强法律的协调性和可操作性,完善儿童参与学校教学及管理制度,优化儿童参与权救济机制。Participation right of children in school education is right w hich child participates in school ad -ministration and teaching activities .Realization of the participation right of children in school education in China is very limited and urgently needed for legal protection .The correlative provisions of present law of China have too much defect ,such as too general of some provisions ,lack of rules to ensure children to ef-fectively participates in school administration and teaching activities ,imperfection of relief mechanism , w hich make it difficult to effectively protect the children ’ s right of participating in school education . Therefore ,we should fulfill in good faith our obligations under Convention on the Rights o f Children ,des-ignate the principle of children’s participation as the basic principles of the protection of children ’s rights , enhance the coordination and maneuverability of the law ,improve children’s participation in school teach-ing and administration system ,and optimize children’s right to participate in relief mechanism.
