摘　　要：在图书馆向读者提供馆藏著作电子版之法律问题方面,《欧盟信息社会的著作权指令》对于该问题的界定及对于《德国著作权法》的修改与重新阐释具有重要意义。文章以"Eugen Ulmer出版社起诉达姆施塔特市科技大学图书馆"一案为考察对象,分析了初审法院、上诉审法院及联邦最高法院的裁决理由,阐述了德国司法部关于赞成抑或反对将《德国著作权法》第52b条的适用范围予以扩张的各界观点,表明了这些观点对于我国《著作权法》修改的重要价值。There are important guiding significance on Copyright Directive of the European Union Information Society related terms to define the problem and to explain again German Copyright Law changes. In this paper, As the Objects of Investigation on the Judgment of the Germany Court on the Case of ＂Eugen Ulmer Press v. the Library of Darmstadt University of Science and Technology＂, the author analyses the rulings on the trial court and the appeal court and the supreme court, expounds the all sorts of views on the scope of Article 52b of German Copyright Law of the German Ministry of Justice, lies in important values for our country.
