经济法实施之差序格局的逻辑演绎及中国经验

摘　　要：经济法的实施是一个发展着的、具有差序性的过程。作为经济法产生的经济学源流,规制理论形塑了经济法实施中政府与法院角色和功能不同的差序格局。透过经济法的制度构造实质上显现的是法学对权力与权利的配置和安顿,并表征了差序格局的制度图谱。经济法的实施不仅在外部受到政治、经济等环境因子的影响,其本身就是一个政治经济过程,从而强化了政府与法院在经济法实施中定位和职能的分野。在我国语境下,政府更为强大、权利有待彰显,经济法的实施有着显著的中国经验。因此,基于差序格局的逻辑,政府和法院应明确自身在经济法实施中的使命,分别以有效规制和权利救济为旨归,迈向治理时代下差序格局的理想形态。The enforcement of economic law is a development and difference process. As the origin of economic law economics,regulation theory shapes the different role and function of the government and the court in economic law enforcement,which could be called＂the pattern of difference sequence＂. Through economic law system structure,it appeared to be the law of power and rights configuration and settled in essence,and character preface-structure system map. The enforcement of economic law should be not only influenced by environmental factors in the external,such as politics,economy,but also a political economic process itself,so as to strengthen the government and the courts in the location and functions distinguished in economic law enforcement. In the context of our country,the government is much more powerful and rights need to be highlighted. We have a conspicuous Chinese experience. Therefore,based on the logic of the pattern of difference sequence,government and the courts should be clear in its mission of economic law enforcement,respectively,with effective regulation and the right remedy for the ideal form of the pattern of difference sequence.
