藏族“赔命价”习惯法积极意义之再认知

摘　　要：藏族"赔命价"习惯法虽历经1 300多年却仍然对藏族群众有着深刻的影响,具有旺盛的生命力。其在解决藏区刑事冲突中的积极意义在于:不仅有利于刑事冲突的彻底解决,以及被害人更好地得到有效赔偿,还有利于更好地限制死刑的适用、贯彻"两少一宽"刑事政策以及实现诉讼效益。The Tibetan ＂life-compensation＂customary law,with a history of more than 1300 years,still has great impact on the Tibetans. It is very significant in Tibet： the law can solve criminal conflicts thoroughly,compensate for the victims,restrain death penalty,implement the policy of less arrest or death penalty and more leniency and realize the benefit of litigation.
