摘 要:修改《立法法》将立法权下放是改革所需发展所要,是中国法治建设实现"良法之治"的关键。地方立法机关和政府也是立法腐败的多发之地,除了要将立法权关在《立法法》的笼子里,从《立法法》自身的角度对立法进行必要的事前防控之外,还应该将立法权关在制度的笼子里,完善的司法审查机制也是防止立法权滥用的最有力防线。为此,不仅应扩大最高人民法院宪法解释提请权的适用情形,还应充分发挥各级人民法院基于宪法而行使的法律选择权和法律解释权,完善人民法院对规章及规范性文件的司法审查权,从而让我国司法审查制真正承载起防止立法权滥用的价值目标。Revised "legislative law"is the critical moment that China construction of rule of law achieves "the rule of good law". To achieve "the rule of good law",in addition to thenecessarybeforehand prevention and control from the "legislation law "itself,perfect judicial review system is the mostpowerful defense line to preventabuse of legislation power. At present,China's judicial review system has many obstacles that isn't conducive to theprevention and control of legislative power,and it isn't "judicial review"in the strict sense in the modern country under the rule of law. It is necessary toperfect our judicialreview system from improving the people'scourt powers,about the power ofrequesting interpret the Constitution,the power of legal interpretation,the power of choosing lawand the power of reviewing regulations and normative documents.
