摘　　要：刑法作为社会控制最权威、最严厉的法律,在社会控制中发挥着不可替代的作用,而从人权保障角度探究死刑,作为司法制度上落实"国家尊重和保障人权"宪法原则的敏感性制度,一直是法学界和社会关注的热点问题。本文在梳理我国死刑现状的基础上,以人权保障为视角,试就死刑适用控制提出建议,以期对我国死刑制度改革有所裨益。As the most authoritative and most stringent law in the social control,the criminal law plays an irreplaceable role in the social control.Research on death penalty from the perspective of the guarantee of human rights,as constitutional sensitive system to implement the ＂state respects and safeguards human rights＂ in the judicial system,has been the focus of the law circles and society.Based on the analysis of the present situation of death penalty in our country,this article puts forward some suggestions on the application of the death penalty from the perspective of the guarantee of human rights in order to benefit the reform of the death penalty system in China.
