农村集体经济组织成员资格界定及相关救济途径研究

摘　　要：近年来,农村集体所有的土地被大量征收,村委会对巨额的土地补偿款如何分配成为全社会关注的热点。根据《最高人民法院关于审理涉及农村土地承包纠纷案件适用法律问题解释》第24条的规定,农村集体经济组织对土地补偿款应该分配给本集体经济组织内部的成员。但是如何合理界定农村集体经济组织成员的资格,急需立法机关作出司法解释加以解决;对于当事人请求确定农村集体经济组织侵犯自己权利的案件,人民法院应以侵害集体组织成员权利纠纷为由予以立案,并将村委会列为被告;还应充分发挥农村集体自治章程和村规民约的作用;同时完善对基层群众自治组织的监督。In recent years, a large amount of rural collective land is levied, and how to divide the large land compensation by village collective becomes the focus of social attention. According to the supreme people＇ s court on the trial involving rural land contract disputes the provisions of article 24, Land compensation should be allocated by the collective economic organizations to the members of the collective economic organizations. How to judge the membership of the rural collective economic organizations are in urgent need to enact laws to define by the legislature; as for cases of requesting to determine the collective economic organizations membership, the people＇ s court shall be put on record for grounds of violation of collective economic organization members rights disputes, and the village committee listed as the defendant ; about cases of defining the rural collective economic organizations membership, the law should give full play to the village collective autonomy of the articles of association and village regulations, and perfect the supervision of the grassroots autonomous organizations at the same time.
