省以下人财物统管背景下的检察机关上下级领导关系研究

摘　　要：文章梳理了我国检察机关上下级领导关系变迁的基本历史,重点将新中国成立后的检察机关上下级领导关系划分为"上级检察院与同级政府‘双重领导’阶段"、"上级检察院‘垂直领导’阶段"和"上级检察院与本级人大的‘双重领导’阶段"。省以下人民检察院人财物统管后会遇到:内部行政化加剧、去"地方化"落实困难、与现行法律存在冲突等问题。应从人财物统管的民主化、透明化,突出检察官的主体地位,解决法律冲突三个方面来应对。This article looks through the history of transition of leadership relationship between upper and lower procuratorates of our country, especially divides the relationship after the founding of new China into three stages： dual leadership by upper procuratorate and the same level of government, vertical leadership by upper procuratorate, dual leadership by upper procuratorate and the local people＇ s congress. The probable problems after the reform of unified management on personnel and finance below provincial organ include internal administrative aggravation, the difficulty of implementing delocalization and conflict with existing law. Finally it gives three suggestions for resolving the problems： strengthening the democracy and transparency of personnel and finance unified management, intensifying the dominant role of procurators disposing of law conflict.
