摘　　要：环评区域限批的复杂性在于,其同时蕴含了垂直的内部命令和外涉的行政干预,并在内部行政"权力—权力"关系和外部行政"权力—权利"关系之双阶构造中全面展开。环评区域限批行为本质上是一种具有外化效力的内部行政行为,其实施需以外部相对人权利的保障为必要限度和价值旨归。为此,应从"控权的内部制约"和"赋权的外部救济"之双重进路,完善限批制度的相关立法。The complexity of regional restricted approval system of environmental impact assessment is that it contains both the vertical internal command and external administrative intervention. In addition, the system reveals its double - lay- er structure in internal administrative relations pointing to ＂power - power＂ and external administrative relations pointing to ＂power - right＂. Regional restricted approval act is in essence a kind of internal administrative act with suspended external effect. Its implementation should take external administrative relative parties＇ rights protection as necessary limits and ending point. Therefore, it is necessary to perfect the relevant regulations on regional restricted approval system of environmental impact assessment by means of internal constraints to control powers and external remedy to give rights.
