摘 要:行政机关负责人出庭应诉制度至今已实施一年之久,从行政机关制定的规范性文件和司法机关的生效裁判文书进行实证分析,可以发现行政机关正职负责人极少出庭,即使出庭也限于部分类型案件,副职负责人出庭应诉已成常态,且副职负责人与委托代理人在诉讼中多为一人。此外,负责人出庭的法律效果以宣示性为主,法院对于负责人未出庭的事由缺乏审查权限,需要靠行政机关强制性规定为补充。随着实践深入,应逐渐改革行政机关诉讼代理人机制,发挥司法建议的作用,完善行政诉讼公开机制,并赋予行政相对人对于负责人出庭应诉的请求权。The system of the person in charge of the administrative organ appear in court has been implemented for a year.From the sample analysis of the normative documents and the judgment documents,it can be found that the head of administrative organs rarely appear in court,but only part of the case type,while the appearance of the deputy director in court has become normalized,and the deputy director mostly served for the entrusted agent role. Furthermore,the legal effect of the head appear in court is mainly declared,and the courts lack review permissions to the reason why the head do not appear. Moreover, the implementation of the person in charge of the administrative organ appear in court depended on administrative mandatory provisions.With the practice,administrative organs AD litem mechanism should be reformed,the role of judicial proposal be play,perfect the administrative litigation mechanism,and the administrative relative person be given right of claim.
