摘 要:总体国家安全观将我国国家安全的法定内涵扩张至广义范畴,进而提出了以反间谍立法为核心来构建广义范畴国家安全法律制度体系的相关法治建设要求。反间谍立法在我国已基本形成一套相对独立的部门法体系,但相关职能部门的职权界分相对模糊,且部分反间谍工作具体事项灵活设定有余而整合不足。应明确相关职能部门职权界分以改善立法可操作性,统筹侦察证件与反间谍控制区域相关具体事项设定以提升立法整合性。The overall national security concept expands the legal connotation of our country's national security to generalized category, and then puts forward relevant requirements of nomocracy construction to build national security legal system in generalized category, the core of which is the anti-spy legislation. Our country's anti-spy legislation has formed a set of relatively independent sector act system basically, but authoritative distinction of interrelated functional departments is relatively fuzzy, besides, some specific items of anti-spy are designed flexible but lack integration. We should explicit authoritative distinction of interrelated functional departments to facilitate the maneuverability of relevant legislation, plan comprehensively the interrelated specific items' setting of reconnaissance certificate and anti-spy control area to promote the conformability of relevant legislation.
