摘　　要：随着我国民主与法制建设的不断进步,稀土资源的勘探、开发、利用、保护和管理等必须有法可依。我国稀土资源保护立法路径可从转变稀土资源保护的立法理念、优化立法结构、平衡立法规范、科学合理设置权义责、立法权的理性配置等方面进行,力求确保我国稀土资源的可持续利用,保障国家经济安全。With the development of democracy and legal system construction in China, government should legislate for the exploration, exploitation, utilization, protection and management of the rare earth resources. To seek a better rare earth resources protection legislation,legislation idea must be transformed, legislative structure must be optimized, legislative norms must be balanced,right,justice and responsibility must be properly configured, and legislative power must be reasonably assigned, ensuring the sustainable u- tilization of rare earth resources in China as well as the national economic security.
