论学生寝室失窃事故中的高校责任

摘　　要：高校学生寝室失窃事故,是指发生在高校大学生寝室内,学生财产被盗从而导致学生财产受损的事故。此时,高校对住宿学生的财产具有安全保障的法定义务;不管高校是故意还是过失,违反这一义务,则应承担相应的侵权责任。在责任归结上,宜对高校适用过错推定责任原则更有利保护受损学生的利益。当然,此时的责任形式和责任主体呈现多元化的态势。在责任形式上,高校负有直接(连带)责任、补充责任和多元主体混合过错下的相应责任。The theft incidents of university students dormitory are those incidents in which personal property of the student is stolen and damaged in the dormitories. In such cases, the university should be held safety - ensuring legal obligation for resident students property. Regardless of its intent or negligence, the university shall bear tort liability because of violation of this obligation. On imputation of legal responsibility of the theft incidents, it is more beneficial to protect interests of the students of suffering property damage, what the university should be applied the principle of fault presumed responsibility. At present, forms and subjects of the liability certainly emerged increasingly diversi-fled development trend. As for forms of liabilities, the university needs to take direct （joint） liability, supplementary duty, and corresponding responsibility under mixed fault of multi - subjects.
