我国多式联运立法现状及对策研究

摘　　要：多式联运法规制度是多式联运发展的基础和保障,本文首先通过文献分析、全国重点多式联运企业的调研问卷分析及多个省份多式联运立法情况的调研走访,总结了我国多式联运立法的现状,剖析阐述了我国多式联运立法存在的多式联运专用法案缺乏、行政法规缺失、责任划分不明晰等问题,立足多式联运发展对规范多式联运当事人经营行为和稳定有序的发展环境的诉求角度,提出了多式联运发展对法规政策的需求包括行政法规和民商法规两方面的需求,最后,针对我国多式联运立法存在的问题和多式联运发展对法规政策的需求,提出了加快我国多式联运法规制度建设的对策建议。Intermodal transport laws and regulations is the foundation and guarantee for the development of intermodal transport. Based on document analysis, intennodal business research questionnaire analysis and the study on legislative status of numerous provinces, the legislative problems including intermodal transport private bill poor, status of intermodal transport in China is analyzed and the lack of administrative regulations and no clear division of responsibilities in that legislative are summarized in this paper. What＇s more, based on demand of regulating business practices and stable and orderly environment for the intermodal transport development, regulations and policies for intermodal transport development including the needs of commercial laws and administrative regulations are put forward. Finally, in view of the problems and intermodal transport development needs for regulations and policies, suggestions to accelerate the construction of intermodal transport laws and regulations are proposed.
