摘  要:随着经济社会的不断发展,用工需求的突增猛长与劳动人口红利呈逐渐收缩的趋势,劳资纠纷日益凸显,使恶意欠薪逐渐发展为影响劳动关系和谐与我国社会经济稳定发展的重要隐忧。规制恶意欠薪行为并非一条刑法修正案所能完全解决的,除将欠薪入刑外,还应借鉴国内外成熟经验、建立欠薪保证金制度、健全多部门共同解决拖欠工资联动机制和发挥司法能动性等多种形式,对欠薪企业实施强有力的把控,进一步提高欠薪企业违法成本,以实现"劳有所得"。With the development of economy and society,there are more cases of labor disputes due to the rapidly increasing needs for labors the decreasing trend of demographic dividend. Defaulting paying wages has become a problem that breaks the labor relation harmony and threatens the stable advancement of China's society and economy. Criminal law is not the only solution to this phenomenon. In addition,related security deposit system should be developed based on successful experiences in other countries. The cooperative system is also an important solution to regulate enterprises by raising the cost of unlawful practice. This will make sure that people are paid for their work.
