摘 要:重大行政决策是当下中国热议的话题之一,对于重大行政决策终身责任追究制度的研究更是数量颇多。由于学者多用传统单一、静止的行政法学方法考察重大行政决策,忽视了重大行政决策复合行政活动的本质,导致了决策责任的遗漏;加之现有重大行政决策程序规定的缺漏和已有制度的牵制,重大行政决策责任追究面临诸多法律困境。欲实现重大行政决策终身责任追究的制度功能,需要明确重大行政决策的范围,构建完整的责任追究体系以及完善相关的配套制度。Major administrative decision-making is one of the hottest issues in China,so many scholars research major administrative decision-making lifelong accountability system. But the scholars apply the traditional methods to research major administrative decisions,whereas ignore that the major administrative decision-making is a composite administrative activities,which led to the omission of the decision-making responsibility; meanwhile,coupled with the limitations of existing major administrative decision- making procedures and the lack of the existing system,the major administrative decisions facing many legal difficulties. In order to get function of the major administrative decision- making lifelong accountability,we have to clarify the scope of major administrative decision-making,construct complete accountability system and improve the relevant supporting system.
