论科技资源高效利用立法的意义

摘　　要：科技资源高效利用是增量资源科学配置与存量资源共享以及其他多种有效使用方式的集成。基于与共享利用制度的比较,揭示科技资源高效利用立法在理念、效益和政治方面的意义。在理念上,其具有相当的社会道德高度,有利激发相关社会主体的积极性,减少制度执行阻力;在效益上,它能抓住科技资源增量这一无限部分,同时对相对有限存量资源的使用又不局限于共享一种方式;在政治上,符合"十八大"以来所坚持的法治治理模式下的改革创新道路。主张制定《科技资源高效利用促进法》,以取代科技部等四部委所主张的《科技资源管理法》或学者提倡的《科技资源共享法》。Efficient utilization of scientific and technological resources is scientific allocation of incremental resources, sharing of stock resources and integration of other effective utilization patterns. Based on comparison with sharing and utilization system, this paper aims at revealing the significance of legislation on efficient utilization of scientific and technological resources in concept, benefit and politics aspects. In concept, the legislation is on a rather high level of social morality, and is beneficial to arouse enthusiasm of relevant social subjects and reduce resistance in its implementation; in benefit, it concentrates on increment of scientific and technological resources such an infinite part, and meanwhile utilization of relatively finite stock resources is not limited to sharing such a single way; in politics, it is in accordance with the reform and innovation road under the model of governance by law since the 18th CPC National Congress. Besides, this paper suggests legislating a Promotion Act for Efficient Utilization of Scientific and Technological Resources to replace Administrative Law of Scientific and Technological Resources put forward by Ministry of Science and Technology and other ministries as well as Law of Scientific and Technological Resources Sharing put forward by some scholars.
