摘　　要：公共部门为了管理社会公共事务需要使用个人信用信息,不仅涉及个人信用信息保护和开放的冲突,还涉及公共利益和个人利益的冲突、公权力和私权利的行使边界。通过对各种利益进行衡量,尽可能寻求其"平衡点"。在公共利益优先的基础上,兼顾具体情形中的具体利益考量,对不同的情形加以区分,采取不同的立法方式。同时,立法应严格限制和明确公共部门使用个人信用信息的目的,并规定具体的行使程序,对公权力的行使加以限制。Thepublic sector＇s management of personal credit information which public affairs need to use,not only include the conflict of the protection and the opening of personal credit information,but also involving the conflict of public interests and personal interests,the border of public power and private right.Through the measure of all sorts of interests,we should seek the ＂ balance＂ as much as possible.Based on the priority of public interests,we should take self-interest in specific circumstances into consideration,distinguish different situation and adopt different ways of legislation.At the same time,the legislation should be strictly limited and focused on the purpose of use of personal credit information by government and regulated the exercise of public power.
