从宋、清两朝“榜告”看湖湘学派对湖南司法的影响

摘　　要：宋、清两朝的湖湘司法"榜告",体现了湖南司法的地方性实践。其在"化弊清讼""以仁恤民""纯良风俗"和"察吏安民"方面,受到湖湘学派"经世致用""熔炼多家""敢为人先"等独具一格的思想影响。对于一种本土思想资源的地方法治利用:它从"人才群体"和"士风民情"两方面,给出了"作为动力的资源"与"作为场境的资源"的现代启示。The proclamations of legality in the Song and the Qing dynasties have featured the local prac- tices of Hunan judicature. Huxiang School, with its unique features of practicability, inclusiveness and crea- tivity, affects local judicature about restraining and rectifying unhealthy litigation, punishing someone who ex- torts a confession by torture, preventing false accusation and formulating regulations for personnel behavior, and so on. It enlightens that resources of elite groups and judicial environment is important for local judicature of modern times.
