摘　　要：我国确立了"犯罪构成是刑事责任的唯一(法律)根据"论断,并形成了刑事责任根据中心论的研究范式,但却"静态有余而动态不足"。面临罪责关系的虚无化、刑事责任动态研究薄弱、体系性认识混乱等现实困局,研究刑事责任动态归责成为必然。从刑事责任根据论到动态刑事责任归责体系的理论突围是刑事责任范畴实现知识转型的必由之路,应以罪责关系为理论原点,遵循静态研究与动态研究并重,导入刑事一体化理念及方法,整合协调正当化事由的体系定位与刑事责任归责体系的理论建构,突出正当化事由的归责意义与功能,建立由犯罪构成与正当化事由构成的刑事责任归责体系。China has gradually established the theory of 44 the crime constitution should be the only one ground to criminal responsibility. The dominated research paradigm of centralization on criminal responsibility ground has been formed. However, the research paradigm of centralization on criminal responsibility ground has methodological drawbacks that it is static more than dynamic and confronted with kinds of defects such as the nihility of the relationship between the category of crime and criminal responsibility and the weakness of dynamic study of criminal responsibility and chaos in systematic knowledge. Thus, the creative research on criminal imputation theory has been initiated. The criminal knowledge transformation that from the ground of criminal responsibility to criminal im-putation theory is an unavoidable theoretical breakthrough, which is based on unbiased method application both in static and dynamic way and massive application of the concept of criminal integration. Meanwhile, the two deep-related issues of the systematic position of the justified circumstances and the construction of criminal imputation system should integrated and solved with further highlight on the imputation meaning and function of the justified circumstances. As a result, the future picture of criminal imputation theory system should be consisted of crime constitution and the justified circumstances with full study of current dynamic criminal law system.
