摘　　要：现行海事履约管理体系源于海事法规体系,但长期滞后于海事法规体系完善步伐等弊端。随着我国"依法治国"方针的不断贯彻落实与海事体系建设的不断完善,海事履约管理体系一定程度上增加了海事执法的风险、体系运行存在诸多不足,这与海事履约体系建立的初衷相背离。因此,摒弃现行海事管理体系的"ISO9000质量管理体系"外衣,还原其海事法规体系本源的新"海事履约管理体系"的构想存在一定的合理性与现实需要。The existing maritime instrument implementation system originated from the maritime legal fiamework, but it has lagged behind the improvement of the maritime legal framework for a long time. With the implementation of China＇ s guideline of rule of law and the improvement of maritime system development, the maritime management system for instrument implementation has increased the risks of maritime law enforcement to a certain extent with its many deficiencies in system operation, which has deviated from the original intention for establishing the system. Therefore, there is certain reasonableness and practical demands for a new management system for maritime instrument implementation, casting off its present cover of ISO 9000 quality management system and returning to its origin of maritime legal framework..
