摘 要:台湾地区"行政诉讼法"和"空气污染防制法"等环境保护法律对受害人民和公益团体针对环境主管机关疏于执法的行为提起公民诉讼做了规定,以维护环境公共利益。对于该类诉讼的性质,存在着普通受害人诉讼抑或公益诉讼、团体诉讼抑或公益诉讼的争论。性质的界定对于原告资格的认定至关重要。台湾地区相关法律中对环境公民诉讼原告资格的认定、诉讼的程序性要件、诉讼类型的选择等规定和理论探讨对大陆地区构建环境行政公益诉讼都具有借鉴意义。In order to protect the environmental public interest, the Administrative Litigation Law, the Air Pollution Control Law and other environmental protection laws stipulate the environmental citizen suit provisions, so that the suffered people and the public interest groups can litigate if the administrative organs are failure to enforce law in the protection of the environments. There are debates on the nature of this kind of litigation, some people think that it is a kind of common administrative litigation, while others think it is a kind of public interest litigation; and some people think that it is a kind of organization litigation, while others think it is a kind of public interest litigation. The nature of this kind of lawsuit is very important to the qualification of the plaintiff. The provisions, including the qualification of the plaintiff, the procedural requirements of litigation, and the choosing of litigation types on the citizen lawsuits, are helpful to the mainland in building a environmental administrative public interest litigation.
