摘　　要：在自然人、法人之外,还存在着"第三民事主体"。"其他组织""非法人团体""无权利能力社团"等名称都不适于作为第三民事主体的名称。民事责任能力是一种客观的财产能力,与民事主体的主观辨识能力无关。从第三民事主体无独立财产、不能独立承担民事责任的角度看,称之为"无责任能力团体"更为恰适。无责任能力团体具有民事权利能力和民事行为能力,但却不具有民事责任能力。有自己的名称,并以团体的名义对外实施民事活动,在法律无除外规定的情况下,由其成员承担无限连带责任的团体,即为无责任能力团体。In addition to the natural person and legal person, there is a ＂ third civil subject＂. ＂ Other Organizations＂ and ＂non -Legal Person Entity＂ and ＂Associations without Legal Capacity＂ are not suitable as the third civil subject name. The capacity for civil liability is an objective property capacity, no relation to the subjective identification of civil subject. From the perspective that the civil subject has no independent property, and cannot independently assume civil liability, ＂Irresponsible Group＂ is a more appropriate name. The Irresponsiblegroup has the capacity for civil rights and capacity for civil conduct, but does not have the capacity for civil liability. All the groups that having its own name, dealing in the name of group, taking unlimited joint liability by its members unless otherwise prescribed by law, are Irresponsible Groups.
