邻避问题中的利益失衡及其治理

摘　　要：利益失衡是邻避问题产生的根本原因,表现为负外部性带来的利益分配不均衡和环境风险在地域与社群中分配的不均衡。然而现有治理方式并未回应失衡的利益结构。要解决邻避问题中的利益失衡,首先要在立法上明确邻避设施利害关系人的法益,避免利益衡量在行政过程中流于形式化。其次要转变决策模式,赋予邻避设施利害关系人话语权。最后要在信息公开、公众参与、利益补偿、监管保障四方面完善利益衡量与平衡制度。Nowadays, the NIMBY Syndrome have become an important and difficult problem in urban governance. The unbalanced interests is the the fundamental cause for NIMBY Syndrome. It is represented as unbalanced interests distribution which lead by negative externality and inequitable distribution of environmental risk in different regions and communities. However, the existing official systematic channels do not respond to the unbalanced interest structure. In order to solve this problem, we should first definitely prescribe the legal interest of stakeholders in legislation. Secondly we should transform the decision -making organization to change the decision -making pattern. Finally we should to improve the systematic channels in four aspects, including information disclosure, public participation, compensation and the regulation of NIMBY facilities.
