摘　　要：解释张力的概念旨在刻画法律解释活动中文本与解释者之间因由权威与服从而产生的紧张关系。这种紧张的解释氛围赋予法律解释不同于其他解释的规范意义,从而凸显了法律解释活动的特殊性。解释张力是对解释活动内部关系和思维规律的揭示与描述。在法律解释过程中,张力作为一个标准能够用来判断解释的效力问题,亦能够影响法律的确定性,以及成为区分抽象解释和具体解释的理论基础。解释张力的研究对我国当下的抽象司法解释制度有重要的实践意义。Tension of interpretation as a concept intends to depict the tension between the text of authority and the interpreter of obedience in legal interpretation activities. The tense atmosphere gives the legal interpretation the normative meaning distinctive from that in other interpretations, highlighting the specialty of legal interpretation. The tension of interpretation reveals and describes the internal relations and the thinking law within interpretation activities. Tension in the process of legal interpretation, as a standard, can be used to judge the validity of interpretation, also affect the certainty of law, and become the theoretical foundation separating the abstract interpretation from the concrete interpretation. The research on the tension of interpretation has great practical significance to China＇ s abstract judicial interpretation system today.
