高校图书馆MOOC版权服务的法律风险及其规避

摘　　要：MOOC版权服务是目前高校图书馆介入MOOC的最主要路径,其主要内容包括版权清理、版权许可申请、寻找免费资源等。但在MOOC版权服务中却将遭遇复制权侵权、网络传播权侵权以及由避风港原则引发的版权纠纷,为此高校图书馆在MOOC版权服务中要做好师生的法律顾问并积极加强与版权中介管理组织的联系以及多渠道的辅助寻找可替代资源。MOOC copyright service is currently the main path for university library to involve MOOC, including copyright clearance, copyright license application, free resource finding. But it will encounter the infringement of copy right and network dissemination as well as the copyright disputes triggered by safe harbor principles. Therefore, university library＇ should do a good job as legal adviser to the teachers and students, and actively strengthen the communication with copyright intermediary organizations, and expand multi-channels to find alternative resource in the MOOC copyright service.
