“问责制”的引入对高职院校体育损伤事故的必要性研究

摘　　要：现阶段高职院校的体育课程是学校教育工作中的核心构成部分之一,其中体育活动包括高职学校中的各类体育课教学、课外体育运动、课下体育锻炼以及体育竞赛。近些年来,由于我国高职院校中的体育事故而引起的学生和学生之间、学生与学校之间的伤害与损害的赔偿纠纷也随之逐渐增多,高职院校方对高额的赔偿费用及其所需要因此而担负的法律责任十分敏感。本文通过对高职院校体育损伤事故的相关研究,做出必要性分析,在保证高职院校学生获得体育锻炼权力的同时,对其中的伤害性事故认定也加以规定,同时还能够从法律的角度上确保学生的合法权益。School sport is an important part of school education, including the types of schools physical education, extracurricular sports activities, after-school sports training and athletic competition. Over the years, caused by sports accidents, the compensation disputes among students and between the student and the school have gradually increased. Colleges fear the high amount of compensation and the legal responsibihty. By researching the accidents and the analysis, this paper proposes that student＇s sport authority should be guaranteed and rules of accident assertion should be clear, and the students＇ legitimate right should be guaranteed.
