职务犯罪预防的立法思考——以行贿犯罪档案查询制度为视角

摘　　要：目前,行贿犯罪档案查询系统并未取得理想效果,表面原因是相关职能部门并未将该系统的查询结果与各行业的信用评价系统、市场评价机制和行政准入制度有效衔接,根本原因在于行贿犯罪档案查询制度定位不明和职务犯罪的预防措施乏力。行贿犯罪档案查询制度只有确立为职务犯罪预防工作的重要组成部分,才能充分实现其设计初衷,立法欠缺是阻却职务犯罪预防取得突破的瓶颈。At present,the file query system of bribery crime did not achieve the desired results. The surface reason is that relevant functional departments did not connect the query results of system with credit evaluation system,market evaluation mechanism,and administrative access system of various industries effectively,but the root cause is the unclear identification of file query system of bribery crime and the weak measures of duty crime prevention.Only through making file query system of bribery crime an important part of duty crime prevention can we achieve its original design. The lack of legislation is the bottleneck for duty crime prevention to achieve a breakthrough.
