法治视域下“维稳怪圈”之成因及破解路径研究

摘　　要：破解"维稳怪圈"是维护社会稳定的重要内容之一。综合来看,"维稳怪圈"是由多重因素所导致的,客观因素是"威胁稳定的社会矛盾",主观因素是"有待改进的维稳思路、模式和方法"。以法治的视角审视,导致"维稳怪圈"的原因主要是在立法、依法行政、司法和守法等方面还存在问题。因此,破解"维稳怪圈",需要树立以"权利保护"为核心的维稳观,实现民主立法、科学立法,运用法治思维和法治方式化解矛盾,实现司法公正,增强司法认同,加强法治文化建设。The removal of ＂vicious circle of stability maintenance＂ is significant to the social stability.Generally,the ＂vicious circle of stability maintenance＂ is resulted from various factors among them is the social contradiction threatening social stability which is the objective factor and unscientific thinking,mode and method of stability maintenance which is the subjective factor.If viewed legally,the reason why the ＂vicious circle of stability maintenance＂ emerged can be traced to the problems existed in legislation,governance by law,administration of justice and law observance.To remove＂vicious circle of stability maintenance＂,we shall act according to stability maintenance conception of right protection,legislate the law compliant with the science and democracy,deal with the contradictions by means of the legal thinking and action,fulfill the judicial justice and strengthen the judicial identification,build the culture of rule of law.
