论我国法定夫妻财产制度的不足与完善

摘　　要：法定夫妻财产制在婚姻关系中意义重大,其不仅为婚姻生活的基本需要提供物质保障,而且关乎夫妻双方的财产利益保护和第三方的交易安全。市场经济的不断发展和成熟,夫妻间财产种类和内容不断丰富,我国现行的《婚姻法》在处理新问题、面对新情况时显得捉襟见肘。对此,本文在剖析我国法定夫妻财产制度立法现状及其不足的基础上,积极借鉴其他国家的相关立法,从而提出完善我国法定夫妻财产制度的意见和建议。Legal couple＇s property system is of great significance in marital relations,which not only provides material guarantee for the basic needs of matrimony,but also correlates to the protection of property interest of couples and the transaction security of the third party. The constant development and maturity of market economy has made the properties and property relationship increasingly various between couples. The current Marriage Law of China is more than willing but lacks the ability to deal with new issues and new circumstances. Hence,based on the analysis of the current situation and deficiency of China ＇s current contractual regime as to marital property legislation and drawing on the legislation of other countries concerning contractual regime as to marital property,this thesis offers opinions and suggestions to the improvements of China＇s legal couple＇s property system.
