摘　　要：另付费旅游纠纷已成为我国旅游纠纷的焦点现象。另付费旅游项目合同不清晰是纠纷发生的主要诱因之一。国内不少学者都在旅游合同研究方面取得成果,其中专门涉及另付费旅游项目合同的仍居于少数。本文力图通过分析另付费旅游项目合同的性质、特点,发掘另付费合同中包含的隐含条款,力图明晰各方主体权利义务关系,查找另付费旅游项目合同纠纷风险点,为规范合同签订与履行提出建设性建议。Extra pay tourism disputes have become the focus of our country tourism disputes. One of the main causes of the disputes is that the extra pay project contract does not clear. Many domestic scholars have made some achievements in studying the travel contract research,but the study referring to the extra pay tourism project contract is still in the minority. This essay tries to analyze the extra pay from the nature and characteristics,find out the implied terms in the contract. The essay also tries to clear the main rights and obligations between the sides,find out the risk points in the contract disputes,and put forward some constructive suggestions for the contract signing and performance standard.
