摘　　要：食品企业道德风险的法律规制是保护消费者基本权益、维系食品企业生存发展以及促进社会和谐稳定的现实需要。当前,我国食品企业道德风险的法律规制面临法律体系不完善、监管体系不健全、舆论监督不到位等现实困境,致使食品企业道德风险频发。因此,我们需要整合国家、政府与社会的力量,通过完善食品安全法律体系、健全食品安全监管体系、强化食品安全舆论监督等途径,严格规制食品企业道德风险,以期促成食品企业尚德守法的良好局面。Legal regulation of food enterprise＇ s moral risk is the realistic needs of protecting consumer＇ s basic rights, maintaining food enterprise＇ s survival and development, promoting social harmony and stability. Legal regulation of food enterprise＇ s moral risk is facing difficulties in China such as imperfect legal system, defective regulatory system and weak public opinion, etc. These factors lead to frequent moral risk of food enterprise. Therefore, we should integrate the strength of our state, government and society for regulating food enterprise＇ s moral risk in order to facilitate a good situation that food enterprises advocate morals and obey laws through perfecting legal system, improving regulatory system and strengthening public opinion in the field of food safety.
