摘　　要：笔者面向作者、数据库商和出版社3类权利人,开展关于数字出版物呈缴意向的调研,分析呈缴意向的趋同性和差异性,内容涉及呈缴主体、呈缴客体、呈缴方式、接受呈缴单位以及奖惩措施等方面。在此基础上,概括数字出版物呈缴制度的现存问题,从法律制度、监管机制、技术规范等方面提出建议,以期为国家制定出台相关法律法规提供数据和理论支撑。This paper investigates the legal deposit intention of three kinds of right holders, such as author, database provider and the publishing house, and analyzes the convergence and the difference of legal deposit intention. The contents include subject, object, mode, aception unit, rewards and punishment of legal deposit. It also summarizes existing problems of digital publication legal deposit system, and proposes the suggestions from three aspects of legal system, regulatory mechanism and technology standard, in the hope of providing the data and theory supports for the formulation and implementation of relavant laws and regulations of China.
