摘  要:以集体经营性建设用地流转为研究对象,基于利益相关者的视角分析了集体经营性建设用地入市利益相关者的利益诉求和利益关系。运用经济学中的契约理论及委托代理等理论,构建了中央政府、乡镇政府公共契约型治理,土地受让方、市县政府交易契约型治理,以及农民、村民小组、农村集体组织内部参与治理的利益相关者共同治理模式,以达到土地流转权力与利益的平衡与相互制衡。With the rotation of profitable collective constructive land as the research object,the interest demand and the interest relationship of profitable collective constructive land access to market stakeholder were analyzed based on the perspective of stakeholder .Using the contract theory and principal-agent theory in economics, build the central government, township government public compact governance, assignee, cit-ies and counties government deal compact governance and farmers’ land, the villagers groups, rural collective organizations to participate in the governance of stakeholders co-governance mode, in order to achieve the balance and checks of power and interests of the land circulation.
