摘　　要：监察专员制度形成于斯堪的纳维亚地区,因其对近代经典三权分立原则的完善而逐渐为西方世界所接受。该制度也丰富了民主与法治原则的内涵,特别是人权保障的功能与价值使其在第三世界广受欢迎。多元化的特点与自我完善的优势使其冲破各种障碍,在全世界150多个国家和地区开花、结果。鉴于其兼顾价值理性与工具理性的优良表现,我们在接受其理念的同时,应试验性地在中国大陆地区建构该制度。The ombudsman system was produced in Scandinavia. It has refined the modern classical Separation of the Three Power and has been accepted by the westernworld The system has enriched the meanings of the principle of democracy and rule of law. Especially, because of its function and value of guarantee ombudsman system is popular in the Third World. Its advan of Human rights, The tages of variety and self-improvement make it break through all kinds of obstacles and be accepted in more than 150 countries of the world. In view of the excellent performance of both Means Rational and Value Rational, we accept its ideas, in the mean time, we should tentatively construct this system in Chinese mainland.
