摘　　要：随着《侵权责任法》的出台,医疗侵权损害赔偿责任在法律上有了新的规定,明确了在医疗纠纷中适用过错责任及附条件的推定过错原则。本文对《侵权责任法》相关规定的理解及在适用中所存在的问题进行了分析。As the Tort Liability Law went into effect, there are new regulations for the medical tort liability, which made clear that the fault liability and conditional presumption of fault principle are applicable in medical disputes. In this paper, the understanding of the relevant regulations in Tort Liability Law and the existing prob- lems in the application process are analyzed.
