摘　　要：本文探讨"胎儿损害请求权主体"的界定及其权益保护的法理基础,论证将胎儿视为有权利能力之主体具有其合理性;并将其损害赔偿请求权进行类型化及胎儿各阶段损害赔偿请求权具体形态化,初步探究了胎儿损害请求权的行使方式。In this paper, the author discusses the definition of the claim subject of fetal damage and the legal basis of its rights and interests protection, demonstrates the rationality of taking fetus as a main body of rights a- bility, categorizes its claim for fetal damage compensation and gives a specific form to the claim for fetal damage compensation in different stages, and carries on the preliminary exploration of the exercise of the claim for fetal damage compensation.
